ENSIEC Under Scrutiny Over Alleged Breach of Supreme Court Ruling on LG Tenure
Whereas the Nigeria constitution stipulates tenures of democratically elected officials at fours years, the Enugu State electoral law pegs tenure of the local government officials at two years.
Following the release of a revised 2026 local government council elections, Concerns are now mounting over whether the Enugu State Independent Electoral Commission is acting in compliance with a landmark Supreme Court judgment that reaffirmed the autonomy and constitutional status of local governments in Nigeria.
The ruling, delivered on July 11, 2024, in Attorney-General of the Federation v. Attorney-General of Abia State & 35 Ors, held that local governments constitute the third tier of government and must be administered by democratically elected officials.
The court also stressed the protection of their tenure and financial independence as essential to strengthening grassroots democracy.
Following the judgment, ENSIEC conducted local government elections in August 2024, producing chairmen and councillors expected to serve their constitutionally recognized terms.
However, recent developments have sparked debate among stakeholders and legal observers over whether any move to alter or shorten the tenure of those elected officials would contradict the spirit and provisions of the Supreme Court’s decision.
Whereas the Nigeria constitution stipulates tenures of democratically elected officials at fours years, the Enugu State electoral law pegs tenure of the local government officials at two years.
Legal analysts say that the judgment reinforced democratic stability at the local government level, warning that interference with the tenure of elected council chairmen could undermine constitutional principles.
They argue that electoral bodies are obligated to align their actions with directives of the apex court.
As the state’s electoral management body, ENSIEC is required to conduct elections in line with constitutional provisions and judicial pronouncements.
Observers note that any perceived deviation raises significant legal and constitutional questions that may require further judicial interpretation.
The ruling has been widely seen as a milestone in promoting accountability, stability, and continuity in local government administration.
Analysts stress that respecting the will of the electorate and adhering strictly to judicial decisions are critical to maintaining confidence in Nigeria’s democratic system.
Calls are now growing for strict compliance with the Supreme Court judgment to avoid potential legal disputes and safeguard democratic governance at the grassroots.
Observers maintain that upholding the tenure of elected officials remains central to preserving the integrity of local government administration nationwide.
